The „New Pact“: new border procedures, more detention, no solution to old problems

An over­view of the most important aspects of the „New Pact on Migra­ti­on and Asyl­um“ from the per­spec­ti­ve of rule of law, Euro­pean law and human rights.

On 23 Sep­tem­ber 2020, the Euro­pean Com­mis­si­on pre­sen­ted its „New Pact on Migra­ti­on and Asyl­um“, a new pro­po­sal for a reform of the Com­mon Euro­pean Asyl­um Sys­tem and the cor­re­spon­ding legis­la­ti­ve instru­ments. PRO ASYL has ana­ly­sed the pro­po­sals and pres­ents the main aspects of the Scree­ning Regu­la­ti­on, the Asyl­um Pro­ce­du­res Regu­la­ti­on, the Asyl­um and Migra­ti­on Manage­ment Regu­la­tio­nand the Cri­sis Regu­la­ti­on. In their inter­ac­tion they under­mi­ne the right to asyl­um in Euro­pe, which is enshri­ned in Artic­le 18 of the Char­ter of Fun­da­men­tal Rights of the Euro­pean Uni­on (CFR).
